In the article, the problem of socio-philosophical bases in the studies of the law and dynamic legal processes is discussed and described. The importance of socio-philosophical level of methodology for law understanding is stated. The idea of updating the required social and philosophical foundations of legal research is held. This thesis against the background of the famous comparison of innovations in the understanding of the essence of social development with the previously prevailing in the domestic science historical materialistic approach is (...) justified. Taking into account some of the dignity of historical materialism, the inability to use it to reveal the deeper side of the social reality of law is asserted. According to the authors, the heuristic potential for an integrated and comprehensive study of the social patterns of legal phenomena is found in the socio-philosophical approach, where the focus is on the phenomenon of ‘interaction‘ as the basis of the maximum social foundation of rights. As a possible source of scientific understanding of the issues under consideration, the national and foreign sociological theories of classical scholars are specified. The formation of the right, law-making, the implementation of the right, legal corresponding connections, and other dynamic processes of law is the result of the set of interactions between social actors, integrated into the legal sphere, and in these interactive links, social laws of the existence of the right should be researched. We are demonstrating that the Luttinger model with short range interaction can be treated as a type of Fermi liquid. In line with the main dogma of Landau’s theory one can define a fermion excitation renormalized by interaction and show that in terms of these fermions any excited state of the system is described by free particles. The fermions are a mixture of renormalized right and left electrons. The electric charge and chirality of the Landau quasi-particle is discussed.

One of the most important philosophical principles in contemporary natural science is the principle of the universality of evolutionary development , which was argued with much force and depth in F. Engels's The Dialectics of Nature. For the more than a century that has passed since Engels's sweeping synthesis of knowledge in the natural sciences, his revelation of the unity of the processes of evolution in inanimate and animate nature, including the inevitably and law-governed appearance of its "highest flower, the (...) thinking mind," where appropriate conditions for that appearance arise, this principle of development has assisted in the achievement of many impressive advances. The general outlines of the evolutionary process of nature, in its infinite diversity, are now emerging in ever sharper relief, although our knowledge of that process still contains many rather serious lacunae. It is significant to note that the progress of natural science leads not only to modifications but often even to radical revisions of many notions about the evolution of nature, including those that seemed unchallengeable. Former research showed that up to 20–25 % of those who leave schools of type VIII are referred to nursery homes for chronic mental patients not due to medical problems but because of social ones. According to the authors’ opinion, such social practice has more positive than negative aspects. However, this issue requires extensive discussions. Organizing special post-diploma training courses of 16–24 hours on ethical-psychological aspects of referral various categories of patients to nursery homes for chronic mental patients also seems (...) to be reasonable. The transition of various countries to socialism is giving birth to a constantly increasing diversity of concrete forms of implementation of the functions of the socialist revolution. At the same time, historical experience shows that the socialist revolution is characterized by certain universal regularities, so that it is a matter of principle, of vital importance, that a revolutionary Marxist party allow for them. Among these, above all, is the need for power to be in the hands of the working class (...) in alliance with all others who labor, the need for abolishing the socio-economic dominance of the capitalist class, and for the new authority to have the capacity to overcome any form of resistance by the class opponents of socialism while uniting the masses of the workers at large in the struggle for the building of the new society. Without the organization and cohesion of the laboring masses headed by the working class, and without converting them into the determining political force, a transition to socialism is impossible: this is the most important conclusion of Marxism-Leninism. This conclusion has found precise expression, with room for all possibilities, in the theory of the dictatorship of the proletariat as the political essence of the transition from capitalism to socialism. Context: The paper utilizes a conceptual analysis to examine the development of abstract conceptual structures in mathematical problem solving. In so doing, we address two questions: 1. How have the ideas of RC influenced our own educational theory? and 2. How has our application of the ideas of RC helped to improve our understanding of the connection between teaching practice and students’ learning processes? Problem: The paper documents how Ernst von Glasersfeld’s view of mental representation can be illustrated in the (...) context of mathematical problem solving and used to explain the development of conceptual structure in mathematical problem solving. We focus on how acts of mental re‑presentation play a vital role in the gradual internalization and interiorization of solution activity. Method: A conceptual analysis of the actions of a college student solving a set of algebra problems was conducted. We focus on the student’s problem solving actions, particularly her emerging and developing reflections about her solution activity. The interview was videotaped and written transcripts of the solver’s verbal responses were prepared. Results: The analysis of the solver’s solution activity focused on identifying and describing her cognitive actions in resolving genuinely problematic situations that she faced while solving the tasks. The results of the analysis included a description of the increasingly abstract levels of conceptual knowledge demonstrated by the solver. Implications: The results suggest a framework for an explanation of problem solving that is activity-based, and consistent with von Glasersfeld’s radical constructivist view of knowledge. The impact of von Glasersfeld’s ideas in mathematics education is discussed. (shrink)

Open peer commentary on the article “Radical Constructivist Structural Design Education for Large Cohorts of Chinese Learners” by Christiane M. Herr. Upshot: Herr’s target article outlines a teaching approach that illustrates and explains how radical constructivism can be used to teach architectural design principles to a large cohort of students. Herr’s approach consists of a hybrid set of instructional activities whose implementation was supported by her establishment of a social climate in the classroom that encouraged the contributions of individuals in (...) the learning process. The activities included the integration of lectures with other teaching formats, the use of open‑ended problem solving tasks, and the use of small‑group projects. I will discuss each of these activities and offer a recommendation for future research. (shrink)
